HomeMy WebLinkAbout2014-03-13 Commissioner Minutes THURSDAY, MARCH 13, 2014 The Franklin County Commissioners met Thursday, March 13, 2014, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. Chairman Keller asked to include Chairman's time prior to public comment. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the amended agenda. Chairman Keller responded to Mr. Lightfoot's comment concerning the contract with Pat Evans who was doing a study on municipal equipment. Mr. Evans did compile a report that included all equipment of various municipalities that participated in the study. The report was provided to the municipalities in August 2013 at a Council of Governments meeting. The work has been satisfied and performed in accordance with that contract. Alicia Kanelopoulos provided public comment and apologized for her outburst on Thursday and she also thanked Mr. Keller for answering her questions after the meeting last week. Chairman Keller thanked Ms. Kanelopoulos for her comment, but added that no apology was necessary. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of March 4, 2014 and March 6, 2014 meetings. The Board reviewed Children and Youth matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the list of Subsidized Adoption Assistance Agreements on behalf of the Franklin County Children and Youth Department to provide a subsidy to adoptive parents to be used for adoptive children for the period of October 24, 2013 through January 14, 2014. Contract listing is maintained for proper accounting of all contracts to include vendor name and type(s) of service provided and rate(s) charged for services. The Board reviewed additional Children and Youth matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the revised 4th Quarter Report to the Department of Public Welfare showing total revenue and expenditures for July 1, 2013 through December 31, 2013 in the amount of $4,243,381.00. The Board reviewed Commissioners' Office matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the lease agreement between the County of Franklin and Effective Software Products, Inc. for rental of Magisterial District Judge Rock's office space at 2038 Lincoln Way East, Chambersburg at a cost of$4,297.00 per month for the period of May 1, 2014 through April 30, 2015. The agreement will automatically renew for four additional one year terms with a 3% increase each year. Continued on page 2 The Board reviewed additional Commissioners' Office matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Supplemental Engineering Agreement between the County of Franklin, Pennsylvania Department of Transportation and C.S. Davidson to increase funding for the preliminary engineering services being provided by C.S. Davidson for Bridge #116, Fannettsburg Road, to a cost not to exceed $362,738.73. All other terms and conditions of the original agreement will remain in full force and effect. The Board reviewed Court Administration matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement between the County of Franklin and Kristen Hamilton to provide legal services for juveniles involved in the delinquency process to ensure juveniles are adequately represented during case processing at a cost of$41,470.04 for the period of January 1, 2014 through December 31, 2014. The Board reviewed Fiscal matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the revised Form 8038-CP to the Department of the Treasury to file semi-annually for the County to claim 45% reimbursement from the Federal Government for the interest paid for the Recovery Zone Economic Development Note. The County will receive a reimbursement in the amount of$5,140.35. The Recovery Zone Economic Development note was paid off January 15, 2014 so this will be the final filing. This form was signed on February 6, 2014 but the IRS required additional documentation. The amount stayed the same. The Board reviewed Grants matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the amendment to the agreement between the County of Franklin and Justice Management Institute (JMI)(dated September 12, 2013) to provide business process analysis to offer solutions to streamline and improve automated and manual systems and processes. After analyzing business processes for court-related departments JMI will recommend modified business processes to improve efficiency and functionality to make a major, positive impact on service delivery. This amendment extends the contract term until June 30, 2014 and increases cost of$3,250.00 with a total of$168,265.00 with $93,350.00 being covered by the PA Commission on Crime and Delinquency— CJAB Initiatives 2010 grant. The term of this contract is September 12, 2013 through March 30, 2014. All other terms and conditions of the original agreement will remain in full force and effect. The Board reviewed Information Technology matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the agreement between the County of Franklin and Tyler Technologies, Inc. MUNIS Division to provide annual support for various MUNIS products at a cost of$64,121.87 for the period of April 1, 2014 through March 31, 2015. The Board reviewed Jail matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the proposal from Lancaster Plumbing and Heating to furnish, install, and service the McQuay chiller for the HVAC system at the Franklin County Jail for a one- time cost of$49,975.00. Continued on page 3 The Board reviewed Juvenile Probation matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the application to Juvenile Court Judges Commission to receive Grant-In-Aid funds in the amount of $134,221.00 for the period of July 1, 2013 through June 30, 2014. In accordance with PA Act14, 67, 68 and 127 notifications, Franklin County Conservation District notified the County of a Pennsylvania Department of Environmental Protection General NPDES permit, being applied by Patricia Allison for an agricultural stream crossing , located in Fannett Township. In accordance with PA Act14, 67, 68 and 127 notifications, Martin and Martin, Inc. notified the County of a Pennsylvania Department of Environmental Protection Solid Waste permit, being applied by Blue Ridge Landfill to increase the maximum daily volume, located in Washington Township. In accordance with PA Act14, 67, 68 and 127 notifications, Martin and Martin, Inc. notified the County of a Pennsylvania Department of Environmental Protection BWEW-GP-11 General permit, being applied by Metal Township Board of Directors to replace an existing concrete culvert for a tributary to the West Branch Conococheague Creek, located in Metal Township. In accordance with PA Act14, 67, 68 and 127 notifications, R. Lee Royer and Assoc. notified the County of a Pennsylvania Department of Environmental Protection General NPDES permit, being applied by Sheffield Manor for construction of townhouses, streets and driveways , located in Washington Township. In accordance with PA Act14, 67, 68 and 127 notifications, R. Lee Royer and Assoc. notified the County of a Pennsylvania Department of Environmental Protection General NPDES permit, being applied by Hoffman Transports Truck Parking for construction of truck parking area , located in Antrim Township. In accordance with PA Act14, 67, 68 and 127 notifications, Gish Logging Inc. notified the County of a Pennsylvania Department of Environmental Protection General Air Quality Program permit, being applied for a 250 HP wood-fired boiler, located in Metal Township. Commissioner Thomas asked to divert from the agenda to apprise the Board on his County Commissioners Association of PA Board of Directors' meeting that happened on Tuesday with legislators. His request was without objection. Once a year the CCAP Board of Directors meet with a number of house and senate leadership to discuss top priority issues. The #1 issue is equity of 911 funding. The Board of Directors made their case well and met with both the majority and minority leadership on both sides of the House and Senate. They understand the counties' situation. Commissioner Thomas pointed out we are approaching $2 million dollars that Franklin County has to fund to provide 911 services because of mandates and new technology needed to comply with state and federal requirements. There was a lot of support from the House to work with PEMA to come up with a plan. The legislative authority for counties to collect a fees to fund 911 expires at the end of June 2014. The county currently collects $1.24 per month for Iandlines and $1 for cell phones. The number of Iandlines have decreased and cell phones have increased and county 911 centers in PA will soon be mandated to accept text messages. Pictures and video are also expected to be required to be received as well, all of which will require technology upgrades. The hope is to get legislation passed to relieve the tax payers by bringing the fees in line with past inflation and the increasing cost to implement and maintain required technology. Commissioner Thomas stated the other issue is restoring the funding cuts to Human Services that has happened over the past several years. CCAP will update counties by the end of the month on these two issues. The meeting was adjourned at 9:52 a.m. with a motion by Robert L. Thomas; seconded by Robert G. Ziobrowski.
