HomeMy WebLinkAbout2014-04-29 Commissioner Minutes TUESDAY, APRIL 29, 2014 The Franklin County Commissioners met Tuesday, April 29, 2014, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. Chairman Keller asked to include Chairman's time to the agenda. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved to adopt the amended agenda. John Hart, County Administrator, requested to include an emergency resolution on the agenda to replace security cameras at the Courthouse Annex. The Board did not oppose this addition. Chairman Keller responded to Mr. Lightfoot's comments about the Board clarifying each item on the board action listing. He said the list is provided to the public on the county's website and provided in the office during each meeting. Chairman Keller said the Board reviews items on the list as necessary. They make themselves available during and after each meeting to answer questions. He stated this is the Board's operating procedure and will continue to be so. Richard Jones provided public comment and said he will make comments at a later date on the rail to trail program that was discussed during a recent meeting. Jay Lightfoot provided public comment to state he feels there is a better use for the money than to waste it on rail to trail projects. The minutes of the April 22, 2014 and April 24, 2014 meetings were reviewed. These will be approved Thursday, May 1, 2014. John Hart, Chief Clerk/County Administrator, asked the Board to approve an emergency resolution #2014-10 for emergency replacement of hybrid DVR, analog & IP camera recording station at the Courthouse Annex. This is needed due to security of the building, customers and employees. He is asking the Board for this purchase to be exempt from bidding. Mr. Hart explained that this vendor is a sole source vendor and they are normally the lowest bid when they bid on projects for the county. Mr. Hart is not sure of the cost but will provide to the board once he receives this information. Chairman Keller asked Mr. Hart to disclose the cost publicly once we get the cost of the equipment. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved Resolution #2014-10 for emergency replacement of hybrid DVR, analog & IP camera recording at the Courthouse Annex. The Board reviewed Agreements, Contracts and Reports. The items will be approved Thursday, May 1, 2014. Mary Beth Shank, Solicitor, requested an executive session to discuss pending litigation. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved to enter an executive session at 9:55 a.m. this date for the purpose to discuss Pending Litigation: Real Estate Tax Appeal 2012-4741 - In Re: Appeal of estside Plaza Associates LP. The Board will also discuss real estate matters during executive session. Action will be required on the pending litigation after executive session. The Board reconvened into regular session at 10:19 a.m. Continued on page 2 Mary Beth Shank, Solicitor, asked approval to settle the Assessment Appeal with Westside Plaza Associates LP #2012-4741. This appeal involves the Food Lion shopping center on Lincoln Way West, Chambersburg and the assessed value is $700,900 which equates to an implied market value of$4,935,915 when you apply the common level ratio. On a motion by Robert G. Ziobrowski, seconded by Robert L. Thomas; unanimously approved to authorize Mary Beth Shank to settle for an implied market value of$4 million for years 2013 and 2014, is equates to an assessment of $568,000 and $588,000 respectively. Prior to the county's approval, the stipulation was approved by Chambersburg Area School District and Franklin County Board of Assessment.
