The Franklin County Commissioners met Thursday, March 31, 2016, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
Richard Starliper, Mayor of Waynesboro, provided public comment and said he is
here due to the LERTA presentation on today's agenda since it affects Waynesboro as
well as the Township. He said he hopes that everything is okay with the request and
that the southern part of Franklin County is thought about.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the March 22, 2016 and March 24, 2016
meetings.
The Board reviewed Commissioners Office matters. On a motion by Robert L.
Thomas, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute the proposal/agreement from C.S. Davidson for Engineering
Services involving required repairs on Bridge #23, located on Tallow Hill Road, at a cost
of$6,000.00.
The Board reviewed additional Commissioners Office matters. On a motion by
Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the
Intergovernmental Agreement between the County of Franklin and St. Thomas Volunteer
Fire Company permitting the use of Franklin County's Analog/Digital radio system for
radio communication for the purpose of public safety and service.
The Board reviewed Grants matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the grant application to
Pennsylvania Commission on Crime and Delinquency (PCCD) for a Residential
Substance Abuse Treatment (RSAT) Program in the amount of$60,000.00 for the
period July 1, 2016 through June 30, 2017. This pilot Jail treatment program will
address the needs of offenders with both alcohol and opiate use disorders from Franklin
and Fulton Counties that provides evidence based Medically Assisted Treatment (MAT)
and behavioral health treatment while at Franklin County Jail and will initiate transition of
treatment to a community provider upon release.
The Board reviewed Jail matters. On a motion by Robert L. Thomas, seconded
by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to
execute the Preventative Maintenance Agreement between the County of Franklin and
Frey Lutz Corporation to provide HVAC equipment maintenance at the jail for the period
of April 1, 2016 through April 1, 2019, at a cost of$21,600.00 per year. Equipment that
will be serviced is as follows: gas boiler, roof top unit, back flow preventers, water
heater, hot water heating pump, chilled water pumps and domestic water pump. Quotes
were requested, three quotes were received, and this was the lowest qualified quote.

The Board reviewed Sheriff matters. On a motion by Robert L. Thomas,
seconded by Robert G. Ziobrowski; unanimously approved the quote from GALL's to
provide Sheriff's Deputies with 18 ballistic vests for a one time cost of$10,621.26.
Quotes were requested, five quotes were received, and this was the lowest qualified
quote.
Mike Ross, President of Franklin County Area Development Corporation
(FCADC), was present to request consideration for designation of LERTA benefits for a
property on Wharf Road in Washington Township. Mr. Ross explained the history and
goal of the LERTA program and the Wharf Road Industrial Park. He has received
LERTA approval from the Waynesboro School District for Lot 5. He explained that lot 5
is the most challenged industrial site in Franklin County because it has a lot of forested
covered rock on the site. Hadley Farms, who produces wholesale baked goods, is
interested in lot 5 which has twenty acres. Hadley Farms has outgrown their current
facility in Smithburg, Maryland and can't make any improvements so they are interested
in buying another property and moving their facility. They have entered into a
contingency sales agreement with Waynesboro Industrial Development Corporation
(WIDC) and they are working with Waynesboro Construction and R. Lee Royer&
Associates to develop plans at this site for their facility. Mr. Ross said this project will
create 150 family sustaining jobs with an average salary to be $44,000 per year. He
said they would be the largest employer in the park. He said LERTA is one of the top
priorities in Hadley Farms' consideration of moving to this lot. Mr. Ross asked the Board
to consider participating in the LERTA program at this location. Commissioner
Ziobrowski asked if the County would be permitted to approve the LERTA on lot 5 only.
Mary Beth Shank, County Solicitor, will research and provide feedback to the Board.
Chairman Keller asked what the timeline is for a decision by the Commissioners. Mr.
Ross said the sooner the better so Hadley Farms can make a decision. He said the
Governors' Action Team is involved and visited the site six weeks ago and they are
putting together an offer to entice Hadley Farms to come over to Washington Township.
Mike Christopher, Washington Township Manager, was present and explained that two
other companies looked at this site but both walked away from it because of cost and
rock issues. He said lot 5 fits LERTA like a T. His concern is that Hadley Farms will
walk away because they can't afford the site costs so WIDC needs this LERTA to level
the playing field. Mr. Christopher said they are only asking for approval of lot 5 from
Franklin County. He has been marketing this site for twenty years and it's an issue that
property is not close to I-81. He thanked the Board for their consideration. Chairman
Keller thanked everyone for the presentation. He said the Board will take the information
under advisement in a timely fashion, and discussion will be on the agenda in the near
future.
David Twaddell, Attorney at Law, was present to request the Commissioners
approve a resolution for issuance of tax exempt obligations related to a proposed
manufacturing facility in Peters Township. Mr. Twaddell said this is a financing project
where the developer would be the Franklin County Area Development Corporation. He
said the property is ten acres for an industrial facility in Peters Township and will be
leased to Atlas Copco Secoroc, LLC. Mr. Twaddell explained that a public hearing was
held on March 30th and no public attended. He explained that IRS code requires that
elected officials give consent to tax exempt financing after a public hearing. He
explained there is no obligation to the County when approving this resolution. Chairman
Keller said this is a wonderful opportunity for all of Franklin County and Tuscarora
School District. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski;
unanimously approved Resolution 2016-05 to approve issuance of tax exempt
obligations related to a proposed manufacturing facility located in Peters Township.
