HomeMy WebLinkAbout2017-11-02 Commissioner Minutes THURSDAY, NOVEMBER 2, 2017 The Franklin County Commissioners met Thursday, November 2, 2017, with the following members present: David S. Keller, Robert L. Thomas and Robert G. Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment of Silence, and the Pledge of Allegiance, proceeded with the business of the day. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. There was no public comment. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. Commissioner Thomas wanted on the record that almost $100,000 is going to Indiana, Armstrong and Butler County's to house inmates. He hopes this will get reduced in the near future. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the minutes of the October 24, 2017 and October 26, 2017 meetings. The Board reviewed Day Reporting Center matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement between the County of Franklin and Maranatha Ministry, Inc. to provide transportation to participants in the Intensive Reentry Case Management program at a cost of$4,000.00 for the period of June 30, 2017 through December 31, 2017. Costs will be covered by the PCCD Intensive Reentry Case Management Grant. The Board reviewed Domestic Relations matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement between the County of Franklin and Kristin N. Nicklas to serve as the Support Master for Domestic Relations Section to maintain and improve the effectiveness of the Child Support Enforcement Program required by Federal regulations at the following costs: $300.00 for non-complex hearings, $500.00 for the first four hours for complex hearings and $100.00 for each subsequent hour, $75.00 for hearing scheduled with the case cancelled/continued 48 hours prior to hearing, and $125.00 for hearing scheduled where parties appeal and settle the case on record. This agreement is for the period of November 6, 2017 through September 30, 2020. The Board reviewed Election matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the use of facilities contract between the County of Franklin and The Church of the Apostles to be used as a polling place being held on November 7, 2017. This contract is for an amount of$150.00. The Board reviewed Emergency Services matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the grant agreement between the County of Franklin and the Pennsylvania Emergency Management Agency (PEMA) for the Hazardous Material Response Fund Grant (HMRF) in the amount of$18,492.04, for the period of July 1, 2017 through June 30, 2018. The Board reviewed Human Resources matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement between the County of Franklin and Dearborn National replacing the current vendor Standard Life Insurance Company, effective January 1 2018 through December 31, 2020, for County Group Life Insurance and Supplemental Life Insurance products, with contract amount based on enrollment Continued on page 2 The Board reviewed Jail matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the agreement between the County of Franklin and Franklin County Jail Ministries to provide Chaplin services through the United Churches of Franklin County at a cost of$25,000.00, for the period of January 1, 2018 through December 31, 2018. The Board reviewed MH/ID/EI matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the updated contract listing for all contracts and addendums for Fiscal Year 2016-2017 for the Mental Health, Intellectual Disabilities and Early Intervention Departments. Contract listing is maintained for proper accounting of all contracts to include vendor name and address, type(s) of service provided and rate(s) charged for services. The Board reviewed Tax Claim matters. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved the 2017 Exoneration of taxes on mobile homes that were abandoned, destroyed or moved out of the County. These same parcels will be exonerated for the 2017 County and County Library taxes in 2018 after the 2017 returns are processed by the Tax Claim Bureau. In accordance with PA Acts 14, 67, 68 and 127 notifications, Dennis E. Black Engineering, Inc. notified the County of a Pennsylvania Department of Environmental Protection Notification of a NPDES Permit application being applied for by Hudson Companies for a proposed Police Barrack, located in Guilford Township. In accordance with PA Acts 14, 67, 68 and 127 notifications, William A. Brindle Associates, Inc. notified the County of a Pennsylvania Department of Environmental Protection NPDES Permit application being applied by Kevin Brechbill for land development to expand a shale parking area and building expansion for Brechbill Trailers, located in Hamilton Township. The Board met with Loretta McClure, Acting Human Resources Director, the Controller Harold Wissinger, and John Hart, Chief Clerk for Salary Board matters. The Planning Office held a public hearing for the Community Development Block Grant (CDBG) Program to get approval on the budget and recommendations. Sam Thrush, Planner, explained that they have had five community input meetings in September and October. There was a public open house in October and there have been four public hearings held during the Commissioner's Board meetings. He said at the last public hearing he went over the recommendations so the Board decided to move forward with advertising of the proposed budget. It was advertised in a newspaper of general circulation. Mr. Thrush said the only comment that was received since the last public hearing was a letter from Quincy Township asking to increase their recommended allocation from approximately $65,000 to $100,000. Chairman Keller opened the floor for public comments. Kerry Bumbaugh, Quincy Township Supervisor, said he expressed Quincy Township's opinion already and informed Eden Ratliff from the Borough of Greencastle, that they are after his money. Mr. Ratliff asked if the budget has changed to which Chairman Keller responded that it has not changed. Mr. Thrush reiterated the following applications and the amounts: the allocation amount is: $292,706.00 with the following recommendations: Borough of Greencastle for an amount of$139,625.00; South Central Community Action Program for an amount of$12,000.00; PathStone Homeownership Program for an amount of$25,800.00 and Quincy Township for an amount of$62,594.00; and the administration amount of$52,687.00. He explained that for the proposed budget to be amended he would have to advertise and hold another public hearing. Commissioner Thomas asked if they can go over the process of how the applicants were selected. Phil Tarquino, Planning Director, explained that they have their own internal point system but it's not a formal document they follow. He said that Continued on page 3 DCED is changing the requirements and they want to see projects that can be completed within 1 year which is the reason the Greencastle project was selected because they can move through their project faster. He's not saying Quincy can't but they are still working with Quincy on past projects. Chairman Keller asked Mr. Bumbaugh how much it would take to make their project more doable. Mr. Bumbaugh responded that one leg of their project is not done but the engineering is complete, quotes have been received, if they can get the $100,000 to make this project happen that would be more helpful. Bob Gunder, Township Supervisor, said the hard costs are $171,000 but through good practices they can do a lot with $100,000 but if they only get $60,000 they would have to split hairs. Mr. Ratliff asked if Quincy is providing a match like Greencastle is. Mr. Thrush responded that Quincy Township is not providing a match. Chairman Keller said that his biggest concern is providing the funds equitably around the County and many funds have already gone to Quincy Township in the past, which were worthwhile projects. He would like to spread the funds around but he can't decide who to take the money from. There was more discussion on the match being provided by Greencastle. Mr. Bumbaugh wanted to remind them that Quincy did not get the funds last year and it was recommended to try for competitive funds. Phil said there has been no approval from the state yet because they are asking for more information from Quincy. It was mentioned that no one can begin work on projects until the funds are approved by the State because they are 2-3 years behind. Mr. Tarquino said Planning just heard from DCED about the 2015 allocation. There was more discussion on how far behind DCED is and why projects can't be started before the applicants receive the funds. The Board was in agreement on the budget and Planning's recommendations. On a motion by Davis S. Keller, seconded by Robert L. Thomas; unanimously approved the CDBG budget as presented. Mr. Thrush also asked the Board to approve two resolutions he provided. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved Resolution #2017-06, 2017 Community Development Block Grant Application Adoption and that the attached resolution be made a part of these minutes. On a motion by Robert L. Thomas, seconded by Robert G. Ziobrowski; unanimously approved Resolution #2017-07, Fair Housing Resolution, and that the attached resolution be made a part of these minutes. The meeting was adjourned at 10:40 a.m. with a motion by Robert L. Thomas; seconded by Robert G. Ziobrowski. FRANKLIN COUNTY COMMISSIONERS County of Franklin Resolution No. 2017 - LQ 2017 COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION ADOPTION WHEREAS, the Commonwealth of Pennsylvania has enacted a State Community Development Block Program; and WHEREAS, said State Community Development Block Grant Program is providing a $299,741.00 grant to Franklin County for the benefit of non-entitlement municipalities; and WHEREAS, the County held public hearings and meetings on October 3, 2017, October 5, 2017, October 17, 2017 and November 2, 2017 relative to the proposed use of Community Development Block Grant funds for fiscal year 2017 NOW, THEREFORE, BE IT RESOLVED BY THE FRANKLIN COUNTY BOARD OF COMMISSIONERS that: 1. The Franklin County Community Development Block Grant Application for fiscal year 2017 is hereby approved. 2. The Chairman of the Board of Commissioners is authorized to execute all required forms and assurances for the application submission to the Department of Community and Economic Development in accordance with Act 179 of 1984. County of Franklin Resolution No.2017- FAIR HOUSING RESOLUTION LET IT BE KNOWN TO ALL PERSONS of Franklin County that discrimination in the sale, rental, leasing, financing of housing or land to be used for construction of housing, or in the provision of brokerage services because of race, color, religion, ancestry, sex, national origin, handicap or disability is prohibited by Title VIII of the Civil Rights Act of 1968 (Federal Fair Housing Law) and the Pennsylvania Human Relations Act. It is the policy of Franklin County to implement programs to ensure equal opportunity in housing for all persons regardless of race, color, religion, ancestry, sex, national origin, handicap or disability, or familial status (families with children), and use of guide or support animals because of the blindness, deafness or physical handicap of the user or because the user is a handler or trainer of support or guide animals. Therefore, Franklin County does hereby pass the following resolution. BE IT FURTHER RESOLVED, that Franklin County shall publicize the attached Fair Housing Advertisement and through this publicity shall cause owners of real estate, developers, and builders to become aware of their respective responsibilities and rights under the Federal Fair Housing Law,the Pennsylvania Human Relations Act,and any local laws or ordinances. FURTHER ACTION will at a minimum include,but not to be limited to: (1)Publicizing the name and contact information of the local Fair Housing Officer, which will include the process to file a complaint if a person feels they have been discriminated against in housing in any manner and other applicable fair housing information through local media and community contracts;and (2) Conduct at least one fair housing activity annually to better inform the public of their rights under the Fair Housing Law and Pennsylvania Human Relations Act;and (3)Use the fair housing logo on all materials dealing with housing programs such as but not limited to: a. Public advertisements for vacancy or discussing the program b.Applications for assistance c.
