TUESDAY, SEPTEMBER 18, 2018
The Franklin County Commissioners met Tuesday, September 18, 2018, with the
following members present: David S. Keller, Robert L. Thomas and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the September 11, 2018 and September 13, 2018 meetings were
reviewed. These will be decided upon on Thursday, September 20, 2018.
The Board reviewed Agreements, Contracts and Reports. Glenda Helman,
Director of Grants, provided information on board action item #4, PCCD project
modification request for the Get Back Up program. She explained the program has
served over 58 individuals and the current caseload is 20. It is growing as communities
make referrals. The biggest referral agency is the Waynesboro Police Department.
Carrie Gray, County Administrator, explained further that the individuals are being
diverted pre-charge so they are not getting arrested. Katie McGrath, Chief Juvenile
Probation Officer, was present to answer questions on board action #7, Juvenile Justice
Grant in Aid. Ms. Gray explained that this grant provides funding in order to provide
more evidence based programs. They do come with a cost so the grant in aid is to
support the overall Juvenile Justice Enhancement Strategies and divert juvenile
offenders from the justice system. Commissioner Thomas asked how much is their
overall budget and how this funding compares to what Adult Probation receives from
their grant in aid. This information will be provided to the Board at a later time. The
following item was approved today while the remaining items will be approved Thursday,
September 20, 2018.
The Board reviewed Grants Management matters. On a motion by Robert G.
Ziobrowski; seconded by Robert L. Thomas; unanimously approved the Project
Modification Request to Pennsylvania Commission on Crime & Delinquency (PCCD) to
request a 12 month no cost extension for the Get Back Up program. In addition to the
no-cost extension, this PMR will move funding from the consultants category to
personnel and benefits to fully cover the cost of the case manager for the 12-month
period. Funding is also being moved from the consultant category to the supply
category to cover the cost of renewal for the case manager's Risk and Needs Triage
(RANT) license.
The Board reviewed Area Agency on Aging matters and conducted a bid opening
recommendation is to not rebid the piano. Chairman Keller asked that the piano not be
discarded but be donated or reused.
The Board reviewed Commissioners Office matters and reviewed bids for the
bridge maintenance program. Steve Malesker, CS Davidson Bridge Engineer, explained
that this bid was for contract #2 for milling of bridge #128. He continued that the solicitor
reviewed the bid and indicated all was in order. Mr. Malesker indicated that the bid is a
good price. He is recommending awarding to Lobar Associates, Inc. On a motion by
Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously approved to award
the bid for the 2018 Bridge Maintenance Program to Lobar Associates, Inc. for a total bid
price of $39,849.20. This proposal is the only bid received. Mr. Malesker mentioned
that no bids were received on the first contract for guide rails. He contacted the
contractor that was interested but who did not bid and he explained that they are very
busy but if we rebid and extend the timeframe for work to be completed there may be
bidders interested. Mr. Malesker explained there is guide rail that is damaged and could
be fixed this year. He said that we could give them 150 days to complete the work. On
a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas; unanimously
approved to rebid contract #1 with 150 days to complete the projects.
Steve Malesker, Bridge Engineer for C.S. Davidson, provided a presentation on
the conditions of Franklin County Bridges. He explained that bridges over 20 feet are
inspected every two years unless they require additional monitoring. There are 77
bridges over 20 feet and 14 bridges under 20 feet for a total of 91 county bridges. He
provided information on structural conditions during 2015 & 2017. There is a downward
migration with conditions per the PennDOT guidelines for coding. There is an increase
they are not safe. He explained further that bridges are excellent for 1-2 years but they
can remain in good condition for 25-30 years. The average age of the counties bridges
are 44 years and Franklin County has the two oldest bridges in District 8. Bridge 128 on
Anderson Road is 196 years old. This is the bridge that will have milling completed that
was discussed during the bid award/reject time earlier in the meeting. Commissioner
Ziobrowski asked if automobiles and heavy vehicles cause damage to bridges since
some were built so long ago. Mr. Malesker responded that traffic reduces the bridge
service life but they need constant maintenance on all bridges and the
crew does an amazing job on maintaining the bridges. He continued that waterproofing
membranes were not in existence 200 years ago since it has only been in existence for
25 years. This process helps to prolong the bridges and protect them. Mr. Malesker
provided information on the different types of bridges and explained there are seven
non-composite adjacent box beam bridges and six of them are over 20 feet. The
average condition on box beams is poor and in 2017 two were posted for weight
restrictions based on cracking issues. He provided pictures of bridges with issues that
were repaired and a few that still need repaired. He provided a chart with projected
revenue compared to expected expenditures that shows a deficit. He explained that
Marcellus Shale funds and Act 44 funds are ending. Commissioner Thomas explained
ties in
the state and we have an interstate highway where people get off and purchase gas so
we are short changed. Chairman Keller thanked Mr. Malesker for the presentation and
continued that this was a great presentation and it shows the issues that our bridge crew
contends with. He appreciates all that C.S. Davidson does and he feels good about the
team they have put together and the work being completed. But there is a funding
challenge ahead of us.
On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to enter an executive session at 10:47 a.m. this date for the
purpose to discuss pending litigation for Tax Assessment cases: In Re: KJS Real Estate
Holdings , LLC v. Franklin County Board of Assessment & Revision of Taxes 2016-4077
and Shanri CVS Chambersburg Inc. v. Franklin County Board of Assessment & Revision
of Taxes 2010-5556. Action will be requested after the executive session. The Board
reconvened into regular session at 11:08 a.m.
Mary Beth Shank, Solicitor asked approval to settle the Assessment Appeal for
Shanri CVS Chambersburg Inc.# 2010-5556 for tax years under the appeal of 2011-
2018. On a motion by Robert G. Ziobrowski; seconded by Robert L. Thomas;
unanimously approved to authorize Mary Beth Shank to enter into an agreement with
settlement of $300,000 for years 2011 and 2012; $325,000 for years 2013-2015;
$350,000 for year 2016; $375,000 for years 2017 and 2018. This equates to a fair
market value ranging from 2.2 million to 2.8 during the appeals years when the
applicable CLR is applied. This agreement has been previously approved by Board of
Assessment and Revision of Taxes, the taxpayer and Chambersburg Area School
District. This approval is also to settle the appeal of KJS Real Estate Holdings, LLC
2016-4077 for tax years of 2017 and 2018. The Board approved settlement of $129,520
for both years, which equates to a fair market value of approximately $925,000.00. This
agreement has been previously approved by the Board of Assessment and Revision of
Taxes, the taxpayer and Chambersburg Area School District.
The meeting was adjourned at 11:10 a.m. with a motion by Robert G. Ziobrowski;
seconded by Robert L. Thomas.
