THURSDAY, JANUARY 16, 2020
The Franklin County Commissioners met Thursday, January 16, 2020, with the
following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
Commissioner John Flannery would like to amend the agenda to pull items #2,
agreement with Black and Davison and #6, Resolution to appoint Black & Davison
G
that he does not know enough about the firm to approve today. Carrie Gray, County
Administrator, asked to include an executive session on real estate matters. On a
motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved
to adopt the amended agenda.
Michelle Jansen provided public comment and said she was surprised by the
news of the potential selection of solicitor for the County. She explained that there is a
history with Black & Davison who are currently suing the Chambersburg Area School
District and the issues with Cathy Dusman and how they felt they were wronged and
willing to sue because of a technicality. They are not a good member of the community
the contract. This is still outstanding and not settled yet. Ms. Jansen wanted to bring
bout it.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the January 6, 2020, January 7, 2020 and January
9, 2020 meetings.
The Board reviewed Commissioners Office matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the Certificate of
Substantial Completion from Stouffer Mechanical Contractor for the Franklin County
Judicial Center Archives Building Phase I.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
Certificate of Substantial Completion for Frantz Plumbing for the Franklin County
Archives Phase 1 project plumbing contract. Noelker and Hull has reviewed and
determined, as of January 11, 2020, the plumbing work has been substantially
completed. Estimated cost of remaining work to be completed or corrected is $325.00.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved Change
Order #7 from Lobar, Inc. (Judicial Center General Construction) to adjust the permit
allowance for excavation permits for an additional cost of $1,697.15.
The Board reviewed additional Commissioners Office matters. On a motion by
John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved Change
Order # 1 from Lycoming Supply, Inc. to provide additional asbestos abatement at the
Elks Parking Lot Demo for an additional cost of $4,760.00.

The Board reviewed District Attorney matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the
Board to execute the Maintenance and Service agreement between the County of
Victim Information and Notification system for the period of January 1, 2020 through
December 31, 2020. This system provides 24/7 operation service, support and
monitoring of hardware and software, 24 hour troubleshooting for system alarms and
incoming and outgoing telephone calls and communication costs. PCCD decided in
2019 that counties are not responsible to pay any portion of the maintenance fees for
2020.
The Board reviewed Human Services matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the updated contract listing
for all contracts and addendums for the period of January 1, 2019 through December 31,
2019 for the Human Services Department. Contract listing is maintained for proper
accounting of all contracts to include vendor name, address, type(s) of services provided
and rate(s) charged for services.
The Board reviewed Prothonotary matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the agreement between the
County of Franklin and Courtney J. Graham, Esquire to provide contract attorney
services at a cost of $2,111.50, for the period of January 1, 2020 through December 31,
2020.
The Board reviewed Recorder of Deeds matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the agreement
between the County of Franklin and Lawrence Rife, IV, Esquire to provide contract
attorney services at a cost of $2,660.30, for the period of January 1, 2020 through
December 31, 2020.
The Board reviewed Reentry Service Center matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved amendment #1 to
the contract between the County of Franklin and Keystone Rural Health Center to
provide Behavioral Health Outpatient Services for the Case Assisted Re-Entry (CARE)
Program. This amendment is to increase the contract from $12,500.00 to $14,000.00 to
cover the amount spent for 2019 psychiatric services under the Case Assisted Re-Entry
(CARE) Program. All other terms and conditions of the original contract will remain in
full force and effect.
The Board reviewed Register of Wills matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved the agreement between the
County of Franklin and Lawrence Rife, IV, Esquire to provide contract attorney services
at a cost of $2,660.30, for the period of January 1, 2020 through December 31, 2020.
In accordance with PA Act notifications, martin and martin, inc. notified the
County of a Pennsylvania Department of Environmental Protection General NPDES
Permit being applied by Edge Rubber Recycling, Inc. for parking lot addition for property
located in the Borough of Chambersburg.
In accordance with PA Act notifications, martin and martin, inc. notified the
County of a Pennsylvania Department of Environmental Protection General NPDES
Permit being applied by JLG Industries, Inc. for parking lot addition for property located
in Antrim Township.

In accordance with PA Act notifications, R. Lee Royer & Associates notified the
County of a Pennsylvania Department of Environmental Protection General NPDES
Permit being applied by A. Duie Pyle to amend an existing NPDES to include the
construction of an additional warehouse and parking for a truck terminal for property
located in the Borough of Chambersburg.
In accordance with PA Act notifications, Triad Engineering, Inc. notified the
County of a Pennsylvania Department of Environmental Protection General NPDES
Permit being applied by the Borough of Waynesboro for Blue Heron Trail at the Renfrew
Museum and Park property located in the Borough of Waynesboro.
John Hart, Project Manager, provided an update on the Court Facility
Improvement Project. He said he was asked by the Chairman to provide an update
every month on the project. He asked the Board to let him know what information they
or constituents would want to hear. The Facility Improvement Project currently consists
of the following five projects: Archives Phase I, d Elks property demolition,
Administration Building, New Courthouse and renovating the old Courthouse. The
Archives, Phase I record storage area is substantially complete and the demolition is
finished for Main Street and Second Street properties. He provided a list of the projects
to the Board detailing the original contract price and approved change orders. Change
orders total less than 1% of the contract price. He explained that county projects are
unique due to county code requiring prevailing wage and five independent contractors
for general construction, electrical, plumbing, mechanical, and for the new judicial facility

contract price is a low percentage. Chairman Keller said there is a percentage in
contingency for change orders that are not expected. Mr. Hart said that due diligence
and planning was performed; however, all underground conditions are not known and
unexpected conditions are uncovered when excavating for subgrade, footers and peers.
Contingency funds are set aside for these unknown conditions. The projects are on
budget and contingency funds are available as needed. His goal is to bring in all projects
less than 5% change orders. Chairman Keller said we are fortunate to have John Hart
and John Boozer to look after the project. Mr. Hart responded that we are fortunate to
have good contractors as well. Mr. Hart provided an update on the Archives project and

records were moved in the storage part of the building on December 12. Controls are
being installed on the heating and ventilation systems. The data center is progressing
with the installation of electric and fiber service. Floor plans for Archives Phase II are
and Archive staff will move in. Steel is being set next week at the Administration
Building. All utilities are roughed in and footers and foundation walls are being backfilled.
This project is on schedule and on budget. He continued that on the Courthouse project
they are finishing pouring footers and basement walls over the next couple of weeks.
Masons are laying up interior support walls and elevator shafts, steel will be delivered in
the middle of February. He continued that the contractors are on schedule with the
completion date of August 2021. Commissioner Flannery said we are at 1% with
change orders and industry standards is 8-10%.

On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter an executive session at 9:55 a.m. this date for the
purpose to review real estate matters. No action will be required after executive session.
The Board reconvened into regular session at 10:50 a.m.
The meeting was adjourned at 10:52 a.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
