WEDNESDAY, AUGUST 12, 2020
The Franklin County Commissioners met Wednesday, August 12, 2020, with the
following members present: David S. Keller, John T. Flannery and Robert G.
Ziobrowski. Chairman Keller presided and after calling the meeting to order, a Moment
of Silence, and the Pledge of Allegiance, proceeded with the business of the day.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to adopt the agenda.
There was no public comment.
The minutes of the August 5, 2020 meeting were reviewed. These will be
decided upon in the afternoon approval session.
The Board reviewed Agreements, Contracts and Reports. The items will be
approved in the afternoon approval session.
The Board reviewed appointments to the Tuscarora Managed Care Alliance
Steering Committee. On a motion by John T. Flannery, seconded by Robert G.
Ziobrowski; unanimously approved to appoint David Keller, Stacie Horvath, Stacey
Brookens, Christy Unger and Teresa Beckner for the term of September 1, 2020 through
August 31, 2021.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved to enter executive sessions at 11:05 a.m. this date to review real
estate and personnel matters. The Board reconvened into regular session at 11:50 a.m.
No action was required after the executive sessions.
The Board recessed and will reconvene at 1:00 p.m. for final approval of the
items that were reviewed.

There was no public comment.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved all bills presented and ordered paid.
On a motion by John T. Flannery, seconded by Robert G. Ziobrowski;
unanimously approved the minutes of the August 5, 2020 meeting.
The Board reviewed Children & Youth matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved the list of
Subsidized Adoption Assistance Agreements on behalf of the Franklin County Children
and Youth Department to provide a subsidy to adoptive parents to be used for adoptive
children, for the period of April 1, 2020 through June 30, 2020. Contract listing is
maintained for proper accounting of all contracts.
The Board reviewed Commissioners Office matters. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of
the Board to execute Change Order #18 from Lobar, Inc. to provide motorized roller
window shades behind the Commissioners desk in the public meeting room at the
Administration Building for an additional cost of $1,173.21.

The Board reviewed Department of Emergency Services matters. On a motion
by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved the
grant agreement between the County of Franklin and the Pennsylvania Emergency
Management Agency to receive a grant in the amount of $6,585.00 for the FY20-21
Radiation Emergency Response Fund Grant for the period of July 1, 2020 through June
30, 2021. This grant provides funding for the development of a detailed nuclear
emergency response plan, training and equipping local emergency response personnel
and exercises of accident scenarios for areas surrounding nuclear generation facilities.
The Board reviewed Tax Claim matters. On a motion by John T. Flannery,
seconded by Robert G. Ziobrowski; unanimously approved to accept a bid on the
repository list made by Bruce M. Cubbage in the amount of $200.00 to purchase a
mobile home located in Waynesboro, PA.
In accordance with PA Act notifications, New Enterprise Stone & Lime Co., Inc.
notified the County of a Pennsylvania Department of Environmental Protection, Bureau
of Air Quality permit being applied to modify an air contamination source at the
Chambersburg Quarry located in Chambersburg, PA.
The Board presented nursing scholarships to recent local high school graduates
who are entering college nursing programs. Chairman Keller provided information on
how the nursing scholarship was created after the sale of the Falling Spring Nursing
Home. Tiffany Bloyer, Human Resources Director, explained that in the past the
Commissioners would attend the ceremonies at the high schools but this year it had to
be done differently. The following graduates were recognized today: Kristina Jones
from Shippensburg Area High School who will be attending Penn State Mont Alto and
Jessica Alvarado from Chambersburg Area High School who will be attending Messiah
University.
The Board reviewed Ordinance #2020-03 to establish procedures and guidelines
for the installation of signal enhancing equipment, such as, but not limited to signal
boosters, associated with the Franklin County Emergency Communications network.
Carrie Gray, County Administrator, explained that this ordinance will allow emergency
services personnel to have a strong signal when responding to emergencies. John
Theirwechter, Assistant County Administrator, explained further that there was some
concern with warehouses or multi-storage buildings communicating in and out of the 911
center. County Solicitor Mark Orndorf said the purpose is to make sure that when the
emergency response team enters a building, the team is able to communicate using the
count
Ziobrowski said it was his understanding this is for new construction and asked if a
municipality can enforce this retroactively. Attorney Orndorf responded that the
ordinance is for new construction only and when they apply for a permit at the township
level that would trigger the enforcement. John Alleman, Antrim Township Supervisor,
Commissioners are approving this. He said their solicitor had some questions on how
this will work and how it will be enforced. Attorney Orndorf responded that the County
would not enforce the ordinance so it would be up to the municipalities and it would start
with the Municipal Code Enforcement Officer. Chairman Keller mentioned that the
Board has not received any negative feedback after the ordinance was advertised. On a
motion by John T. Flannery, seconded by Robert G. Ziobrowski; unanimously approved
Ordinance #2020-03 to establish procedures and guidelines for the installation of signal
enhancing equipment.

The Board reviewed Ordinance #2020-02 providing for the imposition of an
excise tax on the use or occupancy of a room or rooms in a hotel, motel, bed and
breakfast, homestead, inn, guest house or smaller structure held out to the public
for overnight accommodations; establishing procedures for the collection of the
tax imposed; establishing the effective date of this ordinance; and repealing all
ordinances or resolutions insofar as the same shall be inconsistent herewith. Ms.
Gray explained that this ordinance is a modification on occupancy use for
hotel/motels, bed and breakfasts or similar structure held out to the public for
overnight accommodations. The Treasurer and staff felt that modifying an
ordinance would help with collecting this tax. County Solicitor Jerrold Sulcove
explained further that this revised ordinance adds the exemptions from the tax
that are in the PA Code. Chairman Keller said this was reviewed during an
executive session and the Board has no further questions. On a motion by John T.
Flannery, seconded by Robert G. Ziobrowski; unanimously approved Ordinance #2020-
02, to revise the ordinance for Hotel Tax.
The Board held a Retirement Board meeting.
Lee Martin, Marquette Associates, met with the Board to provide a report of the
Franklin County Other Post-Employment Benefits (OPEB) Fund.
The meeting was adjourned at 3:52 p.m. with a motion by John T. Flannery;
seconded by Robert G. Ziobrowski.
