HomeMy WebLinkAbout2009-03-26 Commissioner MinutesTHURSDAY, MARCH 26, 2009 The Franklin County Commissioners met Thursday, March 26, 2009, with the following members present: Robert L. Thomas, David S. Keller and Robert G. Ziobrowski. Chairman Thomas presided and after calling the meeting to order, and the Pledge of Allegiance proceeded with the business of the day. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to adopt the agenda. Public Comment was received from Mr. Allen Piper questioning the discussions in the boardroom on Tuesday concerning Carl Barton's appointment at Guilford Township and Chambersburg Area School District. Mr. Piper is vague about the discussion. The Board explained the new PA law concerning the county-wide collection of earned income taxes and the procedure to appoint a committee with members of townships, boroughs and school districts. The board stated that a question was raised if Mr. Barton could be appointed as a township representative and school board representative and if so would he have two votes. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved all bills presented and ordered paid. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the minutes of March 16, 17, 18, and 19, 2009 meetings. The Board reviewed Sheriff office matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to authorize the Board to sign the invoice for payment of a sheriff vehicle. The Board reviewed Courts matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Contract between the County of Franklin and Kulla, Barkdoll, Ullman & Painter, P.C. to perform duties of conflicts attorney services at a rate of $55,368.00 with an increase of 3% each year for the period of January 1, 2009 through December 31, 2011. The Board reviewed additional Courts matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Contract between the County of Franklin and James K. Reed, P.A. to perform duties of conflicts attorney services at a rate of $55,368.00 with an increase of 3% each year for the period of January 1, 2009 through December 31, 2011. The Board reviewed Election matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Amendment No. 2 to the Help America Vote Act of 2002 Grant Agreements from the Pennsylvania Department of State to extend the grant period by an additional two years to June 30, 2011. Continued on page 2 The Board reviewed Mental Retardation matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Franklin/Fulton Mental Retardation & Early Intervention Encumbrance Listing for FY 2008-2009. The Board reviewed Planning matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved for the Chairman of the Board to execute the Local Government Acknowledgment/Approval from Helicopter Applicators Inc. for aerial spray operations for gypsy moth control. The Board reviewed additional Planning matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Housing Trust Fund Grant Agreement between the County of Franklin and Helping Hands with Hearts for a grant amount of $2,500.00 to be used for the ongoing home repair program to be completed by December 31, 2010. The Board reviewed additional Planning matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Housing Trust Fund Grant Agreement between the County of Franklin and Borough of Chambersburg for a grant amount of $5,000.00 to be used for the Borough of Chambersburg's Elm Street Program to be completed by December 31, 2010. The Board reviewed Tuscarora Managed Care Alliance matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Agreement of Account and Satisfaction between the County of Franklin and the Tuscarora Managed Care Alliance to pay the County in the amount of $9,699.81 for rent and associated occupancy costs for the period of July 1, 2007 through June 30, 2008. The Board reviewed Visitors Bureau matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Contract between the County of Franklin and Centre Publications for a section front in the greater Chambersburg Chamber of Commerce Directory and an interaction online ad at a cost of $1,574.00 for the period of March 26, 2009 through May 29, 2009. The Board reviewed additional Visitors Bureau matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Contract between the County of Franklin and Holtzman Associates/Gary Holtzman to provide three front-line customer service trainings at a cost of $1,600.00 for the period of March 26, 2009 through May 29, 2009. The Board reviewed additional Visitors Bureau matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved the Contract between the County of Franklin and Nexstar Broadcasting, Inc./WHAG TV-25 for the Visitors Bureau to be the key sponsor for the Chambersburg Hometown Proud, Greencastle Hometown Proud and Mercersburg Hometown Proud newscasts and Rouzerville Hometown Proud at a total cost of $3,500.00 for the period of March 26, 2009 through October 1, 2009. Continued on page 3 In accordance with PA 67, 68 and 127 Notifications, Robert J. Yanosky, P.E. notified the County of a Pennsylvania Department of Environmental Protection application being applied for the W.D. Mills Bridge Project located in Metal Township. In accordance with PA 67, 68 and 127 Notifications, R. Lee Royer and Associates notified the County of a Pennsylvania Department of Environmental Protection General NPDES Permit being applied by Anthony Bittner for a commercial subdivision located in Washington Township. In accordance with PA 67, 68 and 127 Notifications, Buchart Horn, Inc. notified the County of a Pennsylvania Department of Environmental Protection General NPDES Permit being applied by Guilford Water Authority for the waterline and well houses project for weIIsBT-1, BT-2 and VQ-1 located in Greene Township. In accordance with PA 67, 68 and 127 Notifications, William A. Brindle Associates, Inc. notified the County of a Pennsylvania Department of Environmental Protection General NPDES Permit being applied by Chambersburg Baptist Church for a church, outdoor pavilion and other site appurtenances located in Greene Township. The Board reviewed Assessment matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to deny the assessment appeal of Franklin County Tax Parcel #OA21 D-091 of John T. & Helen I Shook. The Board reviewed Assessment matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to deny the assessment appeal of Franklin County Tax Parcel #OQ08-475 of Jacob D. & Nikki Estes. The Board reviewed Assessment matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved that the premises of Franklin County Tax Parcel #6625-010 of Discover Properties, Inc. having the assessment of $91,260.00 shall have the lawful assessment of $33,800.00 for the tax year 2009 and all future tax years. The Board reviewed Assessment matters. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved that the premises of Franklin County Tax Parcel #OF12-056 of Kenneth T. and Janet S. Cichowicz having the assessment of $25,900.00 shall have the lawful assessment of $20,000.00 for the tax year 2009 and all future tax years. Doug Amsley, Children, Youth and Family Services Director met with the Board to provide an overview of the Juvenile Probation and Children & Youth 2008 Annual Report. Continued on page 4 Kathleen Pavelko, President and CEO of WITF met with the Board to inform the County of the public service expansion of WITF's new radio station 93.3 available in Franklin County. On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved a special voucher request and ordered paid. The Board held a budget deliberation on how departments are able to reduce their budgets by 8%. There were four days of budget presentations with a lot of information provided and may different approaches to accomplish the task. The Board reviewed all proposals and will take official action on April 2nd On a motion by David S. Keller, seconded by Robert G. Ziobrowski; unanimously approved to enter an executive session at 3:31 p.m. this date for the purpose to review Personnel matters.
