Grace Fogal, of the Borough of Chambersburg, County of Franklin and state of Pennsylvania, being of sound mind, memory, understanding and body, do hereby make, publish and declare this as my last Will and Testament, hereby revoking and declaring null and void any and all other Wills and Test- aments or writings in the nature thereof made by me at any time hereto fore. 1. I order and direct the payment of all my debts and funeral expenses, by my Executor hereinafter so named, as soon as may be conveniently done after my death. 2. I order and direct my Executor hereinafter named to expend the sum of Two Hundred and Fifty ($250.00) Dollars for the purpose of having Two Hundred and Fifty Masses said jointly for the repose of my soul and that of my husband John M. Fogal; this amount shall be free of any in- heritance tax whatsoever, said tax being derived from my Estate. 3. I give and bequeath to the Cemetery Association of Corpus Christi Church of Chambersburg, Pennsylvania the sum of One Hundred and Twenty- five ($125.00) Dollars for the Perpetual Care of my burial lot in said Cemetery, and also for the Perpetual Care of the burial lot of Mrs. Magdalena Shank in said Cemetery. This bequest, likewise, shall be made in the sum indicated above, the inheritance tax being derived from my Estate. 4. I give and bequeath to the Sisters of St. Joseph, Chambersburg, Penn- sylvania, the sum of One Hundred ($100.00) Dollars to be used by the said Sisters of St. Joseph for any purpose whatsoever connected with their Chambersburg residence. Any inheritance tax on this item shall be paid from my Estate, leaving the bequest intact. The receipt of the Mother Superior of said convent shall be sufficient warrant for my Executor. 5. I give and bequeath to the Corpus Christi Church of Chambersburg, Penn- sylvania, the sum of One Hundred ($100.00) Dollars, the same to be used by the Pastor in charge for any worthy Church purpose he may so design- ate; the receipt of the pastor shall be sufficient warrant for the Exe- cutor, and any inheritance tax on this bequest shall be paid out of the general Estate. 6. I give and bequeath to the Society for the Propagation of the Faith at P. 0. Box 323, Carlisle, Pennsylvania, the sum of Seventy-five ($75.00) Dollars, the same to be used for a Perpetual Membership for myself in said Society, and the inheritance tax in this case shall likewise be derived from my Estate. A receipt from the Director of said society shall be sufficient warrant for my Executor. 7. 1 hereby direct that my Executor shall, in public or private sale, sell all my personal and real estate and combine receipts of same in one sum with my liquid assets; after the payments of the sums mentioned in #2, 3, 4, 5, and 6, the following distribution is to be made of the balance of my Estate to wit; A. - The entire sum of said balance shall be placed on interest with the Society of the Propagation of the Faith at P. 0. Box 323, Carl- isle, Pennsylvania, and the interest shall be paid to Mrs. Emma Fogal Kimple, during the time of her married life. B. - If the said Mrs. Emma Fogal Kimple becomes a widow, then she shall be paid one half of this Estate fund outright, the other half of the Estate fund shall be left on interest with the above Society of the Propagation of the Faith, and the interest paid to Mrs. Emma Fogal Kimple until her death, after which event, the half Estate Fund shall be given to the Bishop of the Diocese of Harris- burg for the education of priests for the Diocese of Harrisburg. C. - In the event of Mrs. Emma Fogal Kimple becoming decedent before her husband, Mr. Fred Kimple, the entire Estate Funds invested with the Society for the Propagation of the Faith shall be divided thus, and proper payment made one half of such funds shall be given to the Jesuit Mission Fund of the Province of Maryland, to enroll Mr. John Fogal and me, his wife, in the Perpetual Purgatorial Member- ship; the funds to be used by the Mission Fund for their various purposes; the other half shall be paid to the Bishop of Harrisburg for the Education of Priests of the Diocese of Harrisburg. I here- by authorize my Executor to make, deliver and execute any Deeds pursuant to my property. 8. Lastly, I hereby nominate, constitute and appoint the Valley National Bank of Chambersburg, Pennsylvania to be the Executor of this my last Will and Testament. Mrs. E. Grace Fogal, widow, of the Borough of Chambersburg, County of Franklin, State of Pennsylvania, do make, publish and declare the following to be a codicil to my last will and testament dated October 28, 1950, I give all of my personal effects, other than furniture, but including canned fruit and religious articles, paintings, statues and books, to my daughter, Emma Fogal Kimple pf Chambersburg, Pennsylvania, Route # 3, and direct that my Executor have her access to and possession of them as soon as possible after death. I suggest that she give all or some of the canned fruit to the poor and needy and all or part of my clothes to the clothing drive and any re- ligious articles which she does not desire to keep to the Sisters of Saint Joseph. In all other respects I affirm and republish my last will and test- ament dated October 28, 1950, IN WITNESS WHEREOF, I have hereunto set my hand and seal this 13th. day of December, A. D. 1954. E. Grace Fogal, widow, of the Borough of Chambersburg, County of Franklin, State of Pennsylvania, do make, publish and declare the following to be a second codicil to my last will and testament dated October 2.8, 1950, I substitute for Paragraph 7A the following: The entire sum of said balance shall be placed on interest with the Society of the Propagation of the Faith at P. O. Box 323, Carlisle, Pennsylvania, and the interest thereof shall be paid to Mrs. Emma Fogal Kimple during the time of her married life and, in the discretion of the Society of the Propagation of the Faith, any portion of the principal may be paid to the said Mrs. Emma Fogal Kimple or expended for her account in such amount as may, in the opinion of the said Society, be necessary or proper for her care, support and comfort. I substitute for Paragraph 7B the following: If the said Mrs. Emma Fogal Kimple becomes a widow, then she shall be paid one-half of this Estate Fund outright, The other half of the Estate Fund shall be left on interest with the above Society of the Propagatiofl of the Faith and the int- erest thereof paid to Mrs. Emma Fogal Kimple as well as so much of the principal as may, in the opinion of the said Society, be necessary for her care, support and comfort, until her death, after which such portion of the fund remaining shall be given to the Bishop of the Diocese of Harrisburg for the education of Priests for the Diocese of Harrisburg. In all other respects I affirm and republish my last will and Test- ament dated October 28, 1950, as modified by codicil dated December 13, 1954.
