Members of the Board:
Willis M. Lesher Partnership are requesting a 2 acre subdivision for an additional residential structure. This
easement is identified as County Acquisition #49 and State Acquisition #2253 preserved in 2003 with State funding.
Currently there are no existing structures on this property. The previous existing buildings on the property were
demolished in 2025. According to the regulations of the program found at 7 Pa. Code 138e.224 in addition to the structures existing on the restricted land on the date of granting of the easement, one additional residential structure may be constructed on the restricted land. One of the following must apply, the residential structure is constructed and
used as the landowner’s principal residence or for the purpose of providing necessary housing for seasonal or full-time farm employees. No other residential structure has been constructed on the restricted land, under authority of section 14.1(c)(6)(iv) of the act (3 P. S. § 914.1(c)(6)(iv)) and this section, after the date of the granting of the easement. The proposed subdivision for a residential structure and its curtilage will not exceed 2
acres of restricted land.
It is recommended that it would be in the best interest of the Franklin County Agricultural Land Preservation Board and of the program itself to uphold the program guidelines.
Recommendation: Approve the request for the 2 acre subdivision for purposes consistent with 7 Pa. Code
138e.224.
